HIV & ICE: Know Your Rights
A pocket guide for people living with HIV in the United States. Print, fold, carry. Share it with anyone who might need it.
If ICE Comes to Your Door
- Keep the door closed while checking any warrant. Do not physically resist if officers enter.[1]
- Ask them to slide the warrant under the door or hold it up to a window.
- A judicial warrant is signed by a judge and identifies the person or place it covers. I-200/I-205 forms are administrative warrants. NILC disputes ICE’s claimed authority to force home entry using I-205. State that you do not consent; do not resist.[2]
- You have the right to remain silent. Do not answer questions. Do not sign anything without a lawyer.
If ICE Stops You in Public
- Stay calm. Do not run. Do not resist physically.
- Ask: "Am I free to go?" If yes, walk away calmly.
- If not free to leave, state that you wish to remain silent and call a lawyer. Immigration proceedings generally do not provide a government-paid lawyer.[3]
- Never use false documents. Noncitizens age 18+ must carry issued proof of registration. What you must show depends on your status and situation; ask a lawyer in advance.[4]
Rights Script — Say or Show This
"I am exercising my right to remain silent. I do not consent to entry or a search. I want to speak with a lawyer before answering questions or signing anything."[9]
If detained — HIV-Specific Ask
Say: “I need HIV treatment on schedule. Please contact the medical staff and my clinic now.”[5]
My regimen: Dose / next due:
ICE’s 2025 standards call for uninterrupted HIV treatment in facilities governed by those standards. Ask medical staff and your lawyer to address any delay; a written standard does not guarantee delivery.

VIH e ICE: Conozca Sus Derechos
No responda preguntas. No firme nada sin un abogado.
Si ICE Le Detiene en Público
- Mantenga la calma. No corra. No resista físicamente.
- Pregunte: "¿Puedo irme?"
- Nunca use documentos falsos.
"Ejerzo mi derecho a guardar silencio.

VIH ak ICE: Konnen Dwa Ou
Yon gid pòch pou moun k ap viv ak VIH nan Etazini. Enprime, pliye, mete nan pòch ou.
Si ICE Vini nan Pòt Ou
- Kenbe pòt la fèmen pandan w ap verifye manda a. Si ajan yo antre, pa reziste fizikman.[1]
- Mande yo pou yo glise manda a anba pòt la oswa montre l nan fenèt.
- Yon manda jidisyè gen siyati yon jij epi li idantifye moun oswa kote li konsène a. I-200/I-205 se manda administratif. NILC konteste otorite ICE di li genyen pou fòse antre ak I-205. Di ou pa bay konsantman; pa reziste.[2]
- Ou gen dwa pou rete an silans. Pa reponn kesyon. Pa siyen anyen san yon avoka.
Si ICE Kanpe Ou nan Piblik
- Rete kalm. Pa kouri. Pa reziste fizikman.
- Mande: "Èske m ka ale?" Si yo di wi, mache ale trankil.
- Si ou pa lib pou ale, di ou vle rete an silans epi rele yon avoka. Nan pwosedi imigrasyon, an jeneral leta pa peye avoka ou.[3]
"Mwen sèvi ak dwa mwen pou rete an silans. Mwen pa bay konsantman pou antre oswa fouye. Mwen vle pale ak yon avoka anvan mwen reponn kesyon oswa siyen anyen."[9]
Si yo detni ou — Demann sou VIH
